THE MERCHANT SHIPPING (REPORTING REQUIREMENTS FOR SHIPS CARRYING DANGEROUS OR POLLUTING GOODS) REGULATIONS 1995.
NOTICE IS HEREBY GIVEN that these Regulations implement, in the United Kingdom, EC Directive 93/75/EEC concerning minimum requirements for vessels bound for or leaving Community ports and carrying Dangerous or Polluting Goods. Merchant Shipping Notice M1630 explains how the operator (defined in the Regulations as the owner, charterer, manager or agent of a ship) should comply with the Regulations.
For the purpose of the Regulations, ‘ Dangerous Goods ‘ means goods classified as such in the IMDG Code:
‘’Polluting Goods’‘ means:
- Oil as defined in MARPOL Annex I
- Noxious liquid substances as described in MARPOL Annex II
- Harmful substances as defined in MARPOL Annex III
Bunkers, stores and equipment for use on board ship are not regarded as Dangerous or Polluting Goods for the purpose of the regulations.
Masters of ships not on regular scheduled services to / from Portsmouth are required to complete a checklist of information in accordance with Schedule II of M1630 before entering the Portsmouth Pilotage Area. Masters are required to send a copy of Schedule II to the Harbour Master (Commercial Port) by Facsimile 023 92 824662. A copy of Schedule II is also to be handed to the Pilot on boarding.
Masters of ships on scheduled services of more than one hour’s duration to / from Portsmouth (M1630 para 4.2 refers) are required, on receipt of this Notice, to submit a copy of Schedule II parts A, B and C to the Harbour Master (Commercial Port). They are subsequently to notify the Harbour Master (Commercial Port) of any deficiencies or amendments to the details submitted on Schedule II prior to entry into the Portsmouth Pilotage Area or prior to sailing as appropriate.
Note: For ships on scheduled services of more than one hour it will be acceptable for the information required by Section D of Schedule II to be readily available from the shipping company’s shore office.
A Pilot engaged in berthing, unberthing or manoeuvring a vessel described above who concludes:
a. through his own observations;
b. by reference to the completed Schedule II checklist received from the Master of the ship;
c. by the absence of the check list:
that the vessel has deficiencies which may prejudice its safe navigation must pass this information to the Queen’s Harbour Master on VHF Ch11 immediately. Commercial Pilots must also notify the Harbour Master (Commercial Port).
These procedures do not relieve Masters or Operators of their obligations under the Dangerous Substances in Harbour Areas Regulations 1987. (QHM’s LNTM 03/02 refers).
It should be noted that the Merchant Shipping (Tanker) EEC Regulations are revoked.
